TERMS AND CONDITIONS
Participation
Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to NSW residents aged 18 years and over who have received two (2) doses of a Therapeutic Goods Administration (“TGA”) approved COVID-19 vaccination in Australia at the time of entry into this promotion. COVID-19 vaccines must be undertaken on the advice of a health practitioner.
Employees (and their immediate families) of the Promoterand agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
There are two (2) components to this promotion: (1) an online entry component (“Online Entry”); and (2) a challenge contest conducted at select cricket matches (“Match Challenge”).
Online Entry
Entries into the Online Entry component of the promotion open on 06/12/21 and close at 11:59PM AEDT on 08/12/21 (“Online Entry Period”).
To enter online, entrants must complete the following steps during the Online Entry Period:
· visit https://homestarfinance.com.au/sydney-thunder-bbl-match-day-experience;
· follow the prompts to the promotion entry page;
· input the requested details including their full name, email address and telephone number and postcode; and then
· submit the fully completed entry form.
Limit of one (1) entry into the Online Entry component is permitted per person.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry processor engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of thepromotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete or indecipherable entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The draw for the Online Entry Component will take place at Cricket NSW, 6 Herb Elliott Ave, Sydney Olympic Park, NSW 2125 on 09/12/12 at 12:00PM AEDT. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified by email and telephone.
The first ten (10) valid entries drawn in the Online Entry component will each win two (2) tickets to a cricket match, valued at $40. In addition, the winner and their chosen guest will be eligible to participate in the Match Challenge detailed below (each a “Winning Pair”). The Promoter will allocate two (2) Winning Pairs to each Sydney Thunder cricket match in the order in which they were drawn, on the dates outlined in clause 14 below. For clarity, the prize consists of tickets only and the cost of travel to a cricket match is not included. Winning Pairs must make their own way to and from the cricket match that they have been awarded tickets to.
The total prize pool of the Online Entry component is $400.
Match Challenge
The Promoter will conduct the Match Challenge at cricket matches taking place on the following dates and locations:
Sunday, 12 December 21 at Sydney Showground Stadium;
Sunday, 26 December 21 at Sydney Showground Stadium;
Sunday, 2 January 22 at Sydney Showground Stadium;
Thursday, 13 January 22 at Sydney Showground Stadium; and
Wednesday, 19 January 22 at Sydney Showground Stadium.
On each match day, match attendees will have the opportunity to be selected to participate in a Match Challenge against the previously determined Winning Pairs for that match. To be eligible for selection, each attendee must hold up a promotional sign which can be obtained from the stadium where the match is taking place. Attendees must be present in the stands before the first ball is bowled for that match. One (1) person who is holding up the promotional sign will be selected at random from the crowd by the Promoter (“Match Selected Winner”). Match Selected Winners can select one (1) other person present at the match and they will be given the opportunity to compete against two (2) Winnings Pairs in the Match Challenge for that match. It is a requirement of the Promoter that all Match Selected Winners must have received at least two (2) doses of a TGA approved COVID-19 vaccine and the Promoter reserves the right, at their complete discretion, to disqualify any Match Selected Winner that cannot show evidence of this.
Each Match Challenge will take place before the match has begun and will be comprised of two challenges: (1) a puzzle solving challenge (“Puzzle Challenge”) and (2) a ball throwing challenge (“Ball Throwing Challenge”). The Puzzle Challenge will involve the selected pairs attempting to simultaneously complete a puzzle given to them by the Promoter in the shortest possible time. The pair that completes the puzzle the fastest, according to the Promoter, will move onto the Ball Throwing Challenge (“Successful Pair”).For clarity, the two non-winning pairs will not receive any prize for participating in the Puzzle Challenge.
During the innings break, the Successful Pair will undertake the Ball Throwing Challenge. The Ball Throwing Challenge involves one member of the Successful Pair attempting to throw a ball into the hole of a pop-up tent. Initially, the tent will be set up 50 metres from where the Successful Pair is standing. After each attempt, the tent will be moved closer in 10 metre increments. For example, the tent will start 50 meters away, then after the first attempt, the tent will be moved to 40 metres away, etc. The tent will move regardless of whether the attempt is successful or not. One (1) member of the Successful Pair will have one (1)attempt only to throw the ball into the hole of the pop-up tent at any one time. However, after each attempt, the Successful Pair can choose if they would like to swap who throws the ball (regardless of if the throw was successful or not). The Successful Pair will have a total of five (5) attempts to throw the ball into the hole.
Each time a member of the Successful Pair throws the ball into the hole of the tent, the Successful Pair will win an allocated amount of money, in accordance with the following amounts:
50m: $700
40m: $450
30m: $350
20m: $250
10m: $150
For clarity, any time a member of the Successful Pair throws the ball into the hole in the pop-up tent, the pair will win the amount outlined above. For example, if the Successful Pair throws the ball into the hole in the pop-up tent from 50 meters away and 30 meters away, they will win a total of $1,050. However, if they are unsuccessful on each attempt, they will not win any prize money. The total possible amount a Successful Pair can win is $1,900.
Prize money from the Ball Throwing Challenge (if any) will be made in the form of a direct bank deposit to one member of the Successful Pair, who must each submit their bank details to the Promoter and ensure that all personal details provided are correct. The Promoter will not be responsible for banking institutions rejecting an EFT payment, or any costs associated with locating any prize.
The total prize pool of the Match Challenge component is valued at up to $9,500.
The Promoter reserves the right to refuse to let professional athletes, especially professional cricket players, participate in the Ball Throwing Challenge.
General
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, pandemic, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutoryconsumer guarantees as provided under theCompetition and Consumer Act, as well as any other implied warranties under the ASIC Act orsimilarconsumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (includingits respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of thepromotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,the Promoter (includingits respective officers, employees and agents)is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed athttps://homestarfinance.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out,access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.The Promoter will not disclose PI to any entity outside of Australia.
